Applies to all brands under Overview Effect LLC.

Use of Artificial Intelligence

Some of the tools and features available on our platforms use artificial intelligence (AI) technologies, including, among others, content generation, recommendations, automated assistance, and data analysis. AI-generated results may contain inaccuracies and are provided for informational and educational purposes only; users are responsible for verifying such information before making decisions based on it. By using our platforms, users acknowledge and accept the use of these technologies.

Student Agreement for Online Learning Courses

By registering for the course, I acknowledge and accept the following terms:

Course Participation

I commit to actively participating in the course and following all instructions provided by the Learning Service Provider (LSP) to ensure successful completion of the course content and activities.

Compliance with Guidelines

I will comply with course policies and guidelines, including, but not limited to, submission deadlines, participation expectations, and behavioral standards established at the beginning of the course.

Feedback and Self-Assessment

I am encouraged to provide constructive feedback to improve course content and delivery and to participate in self-assessment activities as directed by the LSP. The following procedures are in place to collect student feedback:

  1. A brief survey is provided at the end of the course to request feedback on the content and overall experience.
  2. A review form is available for students to rate the course on a 1-to-5-star scale and provide comments on their learning experience.
  3. Only selected reviews will be displayed on the course presentation page to help future students make informed decisions.

Feedback and Complaints Procedure

Overview Effect LLC and its brands provide channels for students to share feedback, make suggestions, or submit complaints:

  • Complaints: An expression of dissatisfaction related to our services, platform functionality, content, support, billing, or other aspects. Complaints may be submitted by email to info@overvieweffect.io, info@greenmyexperience.com, or the indicated email address.
  • Suggestions: Feedback to improve services, platform functionality, or course offerings may be provided through the post-training feedback form or through surveys sent to students.

Complaint Management Procedure

  1. Complaints are acknowledged by the Project Owner of the online courses within 72 hours.
  2. The complaint is evaluated by the Project Owner, the Creative Director, and relevant team members from the Learning Department. A neutral responsible person, not involved in the subject of the complaint, is assigned to resolve it.
  3. The responsible person investigates and provides a resolution within 21 days.
  4. Complaint records are stored securely in Google Drive.

Dispute Resolution and Binding Arbitration

If a complaint remains unresolved, students may escalate the matter to info@overvieweffect.io, info@greenmyexperience.com, or the indicated email address, attaching the complaint history and supporting evidence. A neutral mediator will review the case and propose a resolution within 15 business days.

If the dispute is not resolved through the above procedure, the user and Overview Effect LLC agree to the following:

  1. Binding arbitration: Any dispute, claim, or controversy arising out of or relating to these terms, our platforms, courses, or services shall be resolved exclusively through binding, individual arbitration, and not in court, except as provided in item 6.
  2. Rules and venue: The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The seat of arbitration shall be the State of Florida, United States, and it may be conducted remotely (by videoconference or in writing) where the rules allow.
  3. Governing law: These terms are governed by the Federal Arbitration Act (FAA) and the laws of the State of Florida, without giving effect to its conflict-of-laws principles.
  4. Class action waiver: Disputes shall be resolved solely on an individual basis. The user waives the right to participate in class actions, class arbitrations, or representative actions against Overview Effect LLC or its brands.
  5. Jury trial waiver: Both parties waive their right to a trial by jury.
  6. Exceptions: Either party may bring individual claims in small claims court, and Overview Effect LLC may seek injunctive relief in the courts of Florida to protect its intellectual property.
  7. Time limit for claims: Any claim must be initiated within one (1) year of the event giving rise to it; otherwise, it shall be permanently barred to the extent permitted by law.
  8. Costs: Each party shall bear its own attorneys’ fees and costs, unless the AAA rules or applicable law provide otherwise. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.

Support and Additional Resources

The designated support team, accessible through info@overvieweffect.io, info@greenmyexperience.com, or the indicated email address, is responsible for handling suggestions and providing additional support services. These include:

  • Learning support and help desk services.
  • Access to guidance services for academic and course-related matters.
  • Mentoring services to assist students in their educational journey.

Copyright and Use of Materials

The materials provided in the online courses (the “Works”) are the intellectual property of Overview Effect LLC (DBA of ATI Enterprises LLC). By accessing these materials, students acknowledge the following:

  1. The Works are protected under the copyright laws of the United States.
  2. Students are granted a non-exclusive, non-transferable license to use the Works solely for educational purposes as described in the course.
  3. Students are prohibited from reproducing, modifying, distributing, sublicensing, or sharing the Works without the express written consent of the copyright holders.
  4. Unauthorized sharing of access credentials or access codes may result in termination of access without refund.

User-Uploaded Content

Users may upload, post, or share content on our platforms (for example, assignments, comments, reviews, files, or forum posts). By doing so, users acknowledge and accept the following:

  1. The user is solely responsible for the content they upload or share, including its legality, accuracy, and respect for third-party rights.
  2. Overview Effect LLC and its brands are not responsible for content uploaded by users, nor for damages or claims arising from it, and are under no obligation to review or moderate it in advance.
  3. The user represents that they hold the necessary rights to the content they upload and that it does not infringe copyright, trademarks, privacy, or other third-party rights, nor contain illegal, defamatory, or offensive material.
  4. We reserve the right to remove, without prior notice, any content that violates these terms or the law, and to suspend or terminate the access of the users responsible.
  5. The user agrees to indemnify and hold harmless Overview Effect LLC and its brands from third-party claims arising from content they have uploaded.

Data Privacy

I understand that my personal data will be handled with care and confidentiality in accordance with the LSP’s data protection and privacy policy.

Cookies and Google Analytics

Our platforms use Google Analytics, a web analytics service provided by Google LLC, which uses cookies and similar technologies to collect information about site usage (such as pages visited, visit duration, and device type). This information is used in aggregate form to improve our services and the user experience. Google may process this data in accordance with its own privacy policies. Users may disable cookies through their browser settings or install the Google Analytics opt-out add-on (https://tools.google.com/dlpage/gaoptout). By using our platforms, users consent to this data processing.

Completion of Assessments

I acknowledge the importance of completing all required assessments fairly.

Service Level Agreement (SLA)

Service Level Agreement (SLA) for Stakeholder Collaboration

This SLA is entered into between the Learning Service Provider (LSP) and the Stakeholder (for example, an employer or external party), effective immediately, to define roles and responsibilities in the delivery of high-quality learning services.

1. LSP Responsibilities:

  • Design and Delivery: The LSP is responsible for designing and delivering learning experiences that meet educational standards and objectives.
  • Monitoring and Evaluation: Regular monitoring will be conducted to ensure assessments are fair and aligned with predefined outcomes.
  • Continuous Improvement: Stakeholder feedback will be used to improve learning content and delivery.

2. Stakeholder Responsibilities:

  • Feedback: Stakeholders are encouraged to provide feedback on learning services and collaborate in evaluating course effectiveness in meeting organizational needs.
  • Collaboration: Where appropriate, stakeholders may collaborate with the LSP to align learning objectives with organizational or industry goals.

3. Data Privacy:

Both the LSP and stakeholders will ensure the privacy and security of all data in compliance with legal regulations.

4. Review and Improvement:

This SLA will be reviewed annually to incorporate necessary improvements based on stakeholder feedback.

Terms of Service for Online Learning Platforms

These Terms of Service govern the use of online learning platforms operated by the Learning Service Provider (LSP). By using the platform, students and all parties accept the following terms:

LSP Responsibilities:

  • Design and Delivery: The LSP is responsible for the design, development, and delivery of high-quality educational content.
  • Monitoring and Evaluation: The LSP ensures fair assessments and continuous monitoring of the learning experience.
  • Processes and Schedule for Assessing Learning: Assessments are conducted regularly throughout the course to measure progress and outcomes.
  • Continuous Improvement: The LSP collects feedback to continuously improve content and experience.
  • Designated Contact Person: The Project Owner is the designated contact for inquiries and can be reached at meaghen@overvieweffect.io.
  • Data Protection: The LSP will maintain the security and privacy of student data.
  • Learning Support: Learning resources, computer-assisted learning, guidance, and mentoring are available.
  • Copyright and Use of Materials: The LSP complies with licensing agreements to ensure legal compliance.

Student Responsibilities:

  • Compliance with Guidelines: Students must follow course guidelines.
  • Feedback and Self-Assessment: Students are encouraged to participate actively.
  • Completion of Assessments: Students must complete assessments within the established timeframe.
  • Copyright: Reproduction without permission is prohibited.
  • Uploaded Content: Students are responsible for the content they upload to the platform, in accordance with the “User-Uploaded Content” section.

Artificial Intelligence Tools:

The platform may incorporate tools based on artificial intelligence in accordance with the “Use of Artificial Intelligence” section of these terms.

Complaints and Resolution Procedures:

All requests must be directed to info@overvieweffect.io, info@greenmyexperience.com, or the indicated address. Unresolved disputes shall be submitted to arbitration in accordance with the “Dispute Resolution and Binding Arbitration” section.

Non-Compliance:

Non-compliance may result in removal of access.

Privacy Policy:

Use of the platform implies consent to the use of personal data, including the collection of usage data through Google Analytics as described in the “Cookies and Google Analytics” section.

Modifications:

The LSP may modify these terms at any time.

By using the platform, all parties accept these terms.
